The Bar Council of India (BCI) has issued a new recommendation aimed at supporting junior advocates. According to this circular, junior advocates practicing in urban areas should be paid a minimum monthly stipend of Rs 20,000, while those in rural areas should receive Rs 15,000. This recommendation follows a directive from the Delhi High Court issued on July 25, instructing the BCI to address the matter of stipends for junior lawyers.

The BCI issued this circular on October 15, acknowledging the financial struggles that junior advocates face in their initial years. As per the BCI’s recommendation, the minimum stipend should be provided for a period of at least three years from the date of engagement of the junior advocate.

While the BCI strongly encourages the payment of this stipend, it recognizes that not all senior advocates, law firms, or practitioners are in a position to comply uniformly. Due to variations in the financial situations across the legal profession, the recommendation is not mandatory. Senior advocates and firms are urged to follow the guidelines to the best of their ability, but financial limitations will not be seen as a failure of responsibility.
Financial Disparities Among Advocates
The BCI highlighted the significant differences in the earnings potential across the profession:
- Advocates in metropolitan cities tend to earn more, handling high-profile cases or corporate clients.
- Lawyers in rural areas or smaller towns often face limited opportunities and lower-paying cases.
- Practitioners in specialized fields such as corporate law or tax law may have greater financial resources compared to those working in civil or criminal litigation.
Due to these factors, the implementation of this guideline cannot be uniform across the board.

Engagement Terms for Junior Advocates
The BCI has also suggested that senior advocates issue a formal letter of engagement when hiring junior advocates. This letter should outline:
- The stipend amount
- The duration of the engagement
- The scope of mentorship
Junior advocates who do not receive the recommended stipend or encounter other issues related to their engagement can file complaints with their respective state bar councils. However, grievances related to genuine financial constraints will be handled with flexibility.
Regular Review of Guidelines
To ensure the effective implementation of these guidelines, the BCI has announced plans to establish a committee that will periodically review the stipend recommendations. This committee will adjust the stipend amounts based on economic conditions and feedback from the legal community.
High Court Directions
This initiative comes after the Madras High Court directed in July that advocates should pay a minimum stipend of Rs 20,000 for urban areas and Rs 15,000 for rural areas to junior advocates.
